An Act to implement the recommendations of the Task Force for the Payments System Review

Whereas, on June 18, 2010, the Minister of Finance established the Task Force for the Payments System Review to provide the Minister with concrete and actionable advice and recommendations with respect to the modernization of the Canadian payments system;

Whereas, in December 2011, the Task Force for the Payments System Review presented the Minister with its final report, entitled Moving Canada into the Digital Age, in which it recommended that the Government of Canada enact policies that would substantially modern-ize the Canadian payments system by implementing electronic invoicing and payments (EIP) for government transactions, creating a mobile ecosystem in partnership with the private sector and propelling the creation of a digital identification and authentication (DIA) regime to protect the privacy of Canadians;

And whereas the Task Force for the Payments System Review further recommended that the Government of Canada enact legislation to change the governance structure of the Canadian payments system — including that of the Canadian Payments Association — to better meet the needs of consumers and businesses, protect the public interest with a new public oversight body for the payments industry, and encourage collaboration and innovation by all stakeholders through a broad-based, collaborative and self-governing organization;

Attendu :

que, le 18 juin 2010, le ministre des Finances a mis sur pied le Groupe de travail sur l’examen du système de paiement afin que celui-ci lui fournisse des conseils concrets et applicables ainsi que des recommandations au sujet de la modernisation du système canadien de paiements;

que, en décembre 2011, le Groupe de travail sur l’examen du système de paiement a présenté au ministre son rapport final, intitulé Le Canada à l’ère numérique, dans lequel il recommande que le gouvernement du Canada adopte des politiques visant à moderniser considérablement le système canadien de paiements par la mise en oeuvre d’un système de facturation et de paiements électroniques (FPE) pour les transactions du gouvernement, la création d’un écosystème mobile en partenariat avec le secteur privé et la création d’un régime d’identification et d’authentification numérique (IAN) pour protéger la vie privée des Canadiens;

que le Groupe de travail sur l’examen du système de paiement recommande en outre que le gouvernement du Canada légifère de manière à modifier la structure de gouvernance du système canadien de paiements — y compris celle de l’Association canadienne des paiements — afin de mieux répondre aux besoins des consommateurs et des entreprises, de protéger l’intérêt public en créant un nouvel organisme public d’encadrement pour l’industrie des paiements et d’encourager la collaboration et l’innovation chez les intervenants par l’entremise d’une organisation autonome réunissant une large gamme d’intervenants et visant la collaboration,

Now, therefore, Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

2. The Minister of Finance must immediately take all measures necessary to implement the recommendations of the Task Force for the Payments System Review that are set out in its final report of December 2011 to the Minister of Finance, entitled Moving Canada into the Digital Age.

2. Le ministre des Finances prend sans délai toutes les mesures nécessaires à la mise en oeuvre des recommandations énoncées par le Groupe de travail sur l’examen du système de paiement dans son rapport final, intitulé Le Canada à l’ère numérique, remis au ministre en décembre 2011.

3. At the end of the first fiscal year that begins after the coming into force of this Act, and at the end of each of the following four fiscal years, the Minister of Finance must

(a) prepare a report reviewing the progress made during that fiscal year in fulfilling the obligations referred to in section 2; and

(b) cause the report to be laid before each House of Parliament within 90 days after the end of the fiscal year or, if that House is not then sitting, on any of the first 15 days next thereafter that the House is sitting.

3. À la fin du premier exercice commençant après l’entrée en vigueur de la présente loi ainsi qu’à la fin des quatre exercices subséquents, le ministre des Finances :

a) établit un rapport qui examine les progrès réalisés au cours de l’exercice pour s’acquitter des obligations visées à l’article 2;

b) fait déposer le rapport devant chaque chambre du Parlement dans les quatre-vingt-dix jours suivant la fin de l’exercice ou, si celle-ci ne siège pas, dans les quinze premiers jours de séance ultérieurs.
