SUMMARY
The purpose of this enactment is to give greater protection to public transportation workers by creating a new Criminal Code offence of first degree murder, and by imposing a greater punishment for the offence of aggravated assault in cases where such workers are the victims.

An Act to amend the Criminal Code (public transportation workers)
R.S., c. C-46
Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
1. Section 2 of the Criminal Code is amended by adding the following in alphabetical order:
“public transportation worker”
« employé d’un service de transport en commun »
“public transportation worker” means any person employed in, or assigned to, a public transportation service;
2. Subsection 231(4) of the Act is amended by striking out “or” at the end of paragraph (b), by adding “or” at the end of paragraph (c) and by adding the following after paragraph (c):
(d) a public transportation worker acting in the course of his or her duties.
3. Subsection 268(2) of the Act is replaced by the following:
Punishment
(2) Every one who commits an aggravated assault is guilty of an indictable offence and liable
(a) where the complainant is a person described in subsection 231(4), to imprisonment for a term not exceeding twenty years; and
(b) in any other case, to imprisonment for a term not exceeding fourteen years.
4. Paragraph 270(1)(a) of the Act is replaced by the following:
(a) assaults a public officer, peace officer or public transportation worker engaged in the execution of his or her duty or a person acting in aid of such an officer or worker;
