RECOMMENDATION

His Excellency the Governor General recommends to the House of Commons the appropriation of public revenue under the circumstances, in the manner and for the purposes set out in a measure entitled “An Act to amend certain Acts relating to agriculture and agri-food”.

SUMMARY

This enactment amends several Acts in order to implement various measures relating to agriculture.

It amends the Plant Breeders’ Rights Act to amend certain aspects of the plant breeders’ rights granted under that Act, including the duration and scope of those rights and conditions for the protection of those rights. It also provides for exceptions to the application of those rights.

It amends the Feeds Act, the Fertilizers Act, the Seeds Act, the Health of Animals Act and the Plant Protection Act to, among other things,

(a) authorize inspectors to order that certain unlawful imports be removed from Canada or destroyed;

(b) authorize the Minister of Agriculture and Agri-Food to take into account information available from a review conducted by the government of a foreign state when he or she considers certain applications;

(c) authorize the Minister of Agriculture and Agri-Food to issue certificates setting out any information that he or she considers necessary to facilitate certain exports; and

(d) require that a registration or a licence be obtained for conducting certain activities in respect of certain feeds, fertilizers or supplements that have been imported for sale or that are to be exported or to be sent or conveyed from one province to another.

It also amends the Agriculture and Agri-Food Administrative Monetary Penalties Act to, among other things, increase the maximum limits of penalties that may be imposed for certain violations.

It amends the Agricultural Marketing Programs Act to modernize the requirements of the advance payments program, improve its accessibility and enhance its administration and delivery.

Finally, it amends the Farm Debt Mediation Act to clarify the farm debt mediation process and to facilitate the participation of the Minister of Agriculture and Agri-Food in the mediation process when that Minister is a guarantor of a farmer’s debt.

RECOMMANDATION

Son Excellence le gouverneur général recommande à la Chambre des communes l’affectation de deniers publics dans les circonstances, de la manière et aux fins prévues dans une mesure intitulée « Loi modifiant certaines lois en matière d’agriculture et d’agroalimentaire ».

SOMMAIRE

Le texte met en oeuvre diverses mesures en matière d’agriculture par la modification de plusieurs lois.

Il modifie la Loi sur la protection des obtentions végétales afin de modifier divers attributs des droits dont jouissent les titulaires de certificats d’obtention en vertu de cette loi, notamment la durée de validité de ces droits, leur étendue, ainsi que les conditions de protection afférentes. Il prévoit également des exceptions à l’application de ces droits.

En outre, il modifie la Loi relative aux aliments du bétail, la Loi sur les engrais, la Loi sur les semences, la Loi sur la santé des animaux et la Loi sur la protection des végétaux afin, notamment :

a) d’autoriser des inspecteurs à ordonner le retrait du Canada de certaines importations illégales ou leur destruction;

b) d’autoriser le ministre de l’Agriculture et de l’Agroalimentaire à prendre en compte les renseignements obtenus d’un examen effectué par l’administration d’un État étranger lorsqu’il procède à l’examen de certaines demandes;

c) d’autoriser ce ministre à délivrer des certificats énonçant les renseignements qu’il estime nécessaires pour faciliter certaines exportations;

d) d’assujettir à l’obtention d’un enregistrement ou d’une licence l’exercice de certaines activités relativement à certains aliments, engrais ou suppléments qui ont été importés pour la vente ou qui sont destinés à être expédiés ou transportés, d’une province à une autre, ou à être exportés.

Il modifie également la Loi sur les sanctions administratives pécuniaires en matière d’agriculture et d’agroalimentaire afin, notamment, d’augmenter le plafond des sanctions pouvant être infligées pour certaines violations.

Aussi, il modifie la Loi sur les programmes de commercialisation agricole afin de moderniser les exigences du programme de paiement anticipé, d’en améliorer l’accessibilité, ainsi que d’en perfectionner la gestion et la prestation.

Enfin, il modifie la Loi sur la médiation en matière d’endettement agricole afin de clarifier le processus de médiation en matière d’endettement agricole et de faciliter la participation du ministre de l’Agriculture et de l’Agroalimentaire au processus de médiation lorsqu’il est garant de la dette d’un agriculteur.
