An Act to amend the Members of Parliament Retiring Allowances Act (withdrawal allowance)
Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

Alternative title
1. This Act may be cited as the Protecting Taxpayers and Revoking Pensions of Convicted Politicians Act.

MEMBERS OF PARLIAMENT RETIRING ALLOWANCES ACT
2. Section 19 of the Members of Parliament Retiring Allowances Act is renumbered as subsection 19(1) and is amended by adding the following:
Conviction
(2) There shall be paid to a person who ceases to be a member, if he or she has been convicted of an offence under any Act of Parliament that was prosecuted by indictment and for which the maximum punishment is imprisonment for not less than two years and if the offence arose out of conduct that in whole or in part occurred while the person was a member, a withdrawal allowance, in a lump sum, equal to the aggregate of
(a) the total amount of the contributions that the person has paid under this Part and Parts I, III and IV of the former Act, and
(b) the interest on those contributions that the person has paid under section 11 or 11.1 or under section 23 of the former Act.
3. Section 39 of the Act is renumbered as subsection 39(1) and is amended by adding the following:

Application
4. Subsections 19(2) and 39(2) of the Members of Parliament Retiring Allowances Act, enacted by sections 2 and 3, apply, with respect to any person that is a member of the Senate or House of Commons, to conduct that occurred before June 3, 2013.
