An Act to amend the Parliament of Canada Act (confidence motion)
R.S., c. P-1
Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
1. The Parliament of Canada Act is amended by adding the following after section 2:
Expression of no confidence
2.1 (1) A motion made in the House of Commons to express no confidence in the government shall contain the following statement:
That this House has no confidence in the government.
Motions
(2) Subsection (1) applies to any motion, including
(a) a motion for an address in reply to a Speech from the Throne;
(b) a motion for approval of the budgetary policy of the government pursuant to Standing Order 84(1) of the House of Commons;
(c) an opposition motion proposed on an allotted day pursuant to Standing Order 81(10) of the House of Commons; and
(d) a motion opposing the second or third reading of a government bill, despite any existing usage or practice of the House regarding the admissibility of amendments at those stages.
Ways and means motions
(3) The defeat by the House of Commons of a ways and means motion, other than a motion referred to in paragraph (2)(b), or of a motion to concur in main and supplementary estimates or in interim supply, shall be deemed to be an expression of no confidence in the government in accordance with subsection (1).
14-day period
(4) The government shall be considered to have lost the confidence of the House if a period of 14 days has passed since a motion referred to in subsection (2) has been adopted by the House and if, during that period, the House has not passed a motion that contains the following statement:
That this House has confidence in the government.
2. Section 3 of the Act is replaced by the following:
Prerogative saved
3. Nothing in section 2 or 2.1 alters or abridges the power of the Crown to prorogue or dissolve Parliament.
