SUMMARY
This enactment amends the Criminal Code to establish that personating a police officer or a public officer for the purpose of committing another offence must be considered by a court to be an aggravating circumstance for sentencing purposes.

Le texte modifie le Code criminel afin de prévoir que le fait de prétendre faussement être un agent de la paix ou un fonctionnaire public en vue de commettre une autre infraction est considéré comme une circonstance aggravante par le tribunal qui détermine la peine à infliger.

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
Sa Majesté, sur l’avis et avec le consentement du Sénat et de la Chambre des communes du Canada, édicte :

1. The Criminal Code is amended by adding the following after section 130:
1. Le Code criminel est modifié par adjonction, après l'article 130, de ce qui suit :
Aggravating circumstance
130.1 If a person is convicted of an offence under section 130, the court imposing the sentence on the person shall consider as an aggravating circumstance the fact that the accused personated a peace officer or a public officer, as the case may be, for the purpose of facilitating the commission of another offence.
130.1 Le tribunal qui détermine la peine à infliger à la personne déclarée coupable d'une infraction prévue à l'article 130 est tenu de considérer comme circonstance aggravante le fait que l'accusé a prétendu faussement être un agent de la paix ou un fonctionnaire public, selon le cas, en vue de faciliter la perpétration d'une autre infraction.
