SUMMARY
This enactment amends the Access to Information Act to provide that, if a request for access to a record under that Act is still outstanding one hundred days after the request is received, the head of the government institution to which the request was made shall send a report to the person who made the request and to the Information Commissioner, setting out a full explanation of the delay and the projected completion date. The Information Commissioner’s annual report to Parliament shall include the number of such outstanding requests and identify the responsible government institutions.
SOMMAIRE
Le texte modifie la Loi sur l’accès à l’information afin de prévoir que, dans le cas où une demande de communication de document est encore en suspens cent jours après sa réception, le responsable de l’institution fédérale à qui elle est faite est tenu d’envoyer à l’auteur de la demande et au Commissaire à l’information un rapport donnant une justification complète du retard et la date prévue pour le traitement de la demande. Le rapport annuel que le Commissaire à l’information présente au Parlement doit faire état du nombre de ces demandes et du nom des institutions fédérales qui en sont responsables.

1. The Access to Information Act is amended by adding the following after section 9:
1. La Loi sur l’accès à l’information est modifiée par adjonction, après l’article 9, de ce qui suit :
Report after one hundred days
9.1 (1) Where a request for access to a record under this Act is still outstanding one hundred days after the request is received, the head of the government institution to which the request was made shall send a report to the person who made the request and to the Information Commissioner setting out a full explanation of the delay and the projected completion date.
9.1 (1) Dans le cas où une demande de communication de document est encore en suspens cent jours après sa réception, le responsable de l'institution fédérale à qui elle est faite envoie à l’auteur de la demande et au Commissaire à l’information un rapport donnant une justification complète du retard et la date prévue pour le traitement de la demande.

(2) The number of requests that were still outstanding one hundred days after they were received, and the government institutions responsible for those requests, shall be included in the annual report that the Information Commissioner is required to submit to Parliament under section 38.
(2) Le nombre de demandes encore en suspens cent jours après leur réception et le nom des institutions fédérales qui en sont responsables doivent figurer dans le rapport annuel que le Commissaire à l’information présente au Parlement en application de l’article 38.
