Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. The Canada Pension Plan is amended by adding the following after section 44:
|
|
|
|

Survivor’s pension not payable
|
|
44.1 (1) A survivor of a contributor is not entitled to receive a survivor’s pension as a result of the death of the contributor if the survivor is convicted of the murder or manslaughter of the contributor.
|
|
|
|
44.1 (1) Le survivant déclaré coupable du meurtre ou de l’homicide involontaire coupable du cotisant n’a pas droit à la pension de survivant payable par suite du décès du cotisant.

Death benefit not payable
|
|
(2) A survivor or child of a contributor is not entitled to receive a death benefit as a result of the death of the contributor if the survivor or child is convicted of the murder or manslaughter of the contributor.
|

(2) Le survivant ou l’enfant déclaré coupable du meurtre ou de l’homicide involontaire coupable du cotisant n’a pas droit à la prestation de décès payable par suite du décès du cotisant.

Orphan’s benefit not payable
|
|
(3) An orphan of a contributor is not entitled to receive an orphan’s benefit as a result of the death of the contributor if the orphan is convicted of the murder or manslaughter of the contributor.

|
(3) L’orphelin du cotisant qui est déclaré coupable du meurtre ou de l’homicide involontaire coupable de ce cotisant n’a pas droit à la prestation d’orphelin payable par suite du décès du cotisant.
