An Act relating to railways

Loi concernant les chemins de fer

Preamble

Whereas the introduction of a pro forma bill in the Senate before the consideration of the Speech from the Throne demonstrates the right of the Senate to act without the leave of the Crown;

Whereas that custom, which can be traced to before 1867 in the Parliament at Westminster, is practised in a number of jurisdictions having a parliamentary form of government;

And whereas it is desirable to explain and document the constitutional relationship represented by that custom, while preserving the traditional title of the pro forma bill;

Now, therefore, Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

Attendu :

Préambule

que le dépôt d’un projet de loi pro forma avant l’examen du discours du Trône par le Sénat démontre le droit du Sénat d’agir sans l’autorisation de la Couronne;

que cette coutume peut être retracée avant même 1867, au Parlement de Westminster, et est observée dans divers États ayant adopté le parlementarisme comme forme de gouvernement;

qu’il est souhaitable d’expliquer et de documenter la relation constitutionnelle représentée par cette coutume tout en conservant le titre traditionnel du projet de loi pro forma,

Sa Majesté, sur l’avis et avec le consentement du Sénat et de la Chambre des communes du Canada, édicte :

Assertion of right

1. This bill asserts the right of the Senate to give precedence to matters not addressed in the Speech from the Throne.

1. Le présent projet de loi constate le droit du Sénat de donner préséance à des questions autres que celles abordées lors du discours du Trône.
