An Act to amend the Statutory Instruments Act (regulatory reduction)
R.S., c. S-22
Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
SHORT TITLE
Short title
1. This act may be cited as the Red Tape Review and Reduction Act.
STATUTORY INSTRUMENTS ACT
2. The Statutory Instruments Act is amended by adding the following after section 15:
REGULATORY REDUCTION
Regulatory reduction
15.1 (1) Every regulation-making authority shall, on an annual basis, review the effectiveness of the regulations made by it and establish targets for regulatory reduction by
(a) examining the current regulatory envi­ronment to determine whether the regulatory burden on businesses in Canada interferes with their ability to compete with businesses outside Canada;
(b) consulting with other regulation-making authorities to ensure consistency of regulatory regimes;
(c) consulting with persons and organizations that are subject to existing regula- tions, or that would be subject to proposed regulations, to identify issues that are caused, or that may be caused, by the application of those regulations; and
(d) identifying regulations that could be amended or revoked to reduce the regulatory burden on businesses in Canada.
Annual targets
(2) Every regulation-making authority shall implement the annual targets for regulatory reduction referred to in subsection (1) by amending and revoking regulations as necessary.
Annual report
(3) Every regulation-making authority shall
(a) prepare an annual report on the results of the review referred to in subsection (1) and the regulatory reduction measures it has taken in the previous fiscal year; and
(b) on or before March 31 in each year, submit the report to the Clerk of the Privy Council.
Tabling in Parliament
(4) The Clerk of the Privy Council shall, on or before May 31 in each year, submit a report on the regulatory reduction measures taken by all regulation-making authorities in the previous fiscal year to the Prime Minister, and the Prime Minister shall cause a copy of the report to be laid before each House of Parliament on any of the first 15 days on which that House is sitting after the Prime Minister receives it.
