SUMMARY
This enactment amends the Canada Transportation Act to control noise and vibrations produced by the construction and operation of railways located in close proximity to any residential, institutional or commercial establishments at certain times or on certain days.

An Act to amend the Canada Transportation Act (railway noise and vibration control)
Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
SHORT TITLE
1. This Act may be cited as the Railway Noise and Vibration Control Act.

2. The Canada Transportation Act is amended by adding the following after section 95.1:
Prohibited activities
95.11 When constructing or operating a railway within 300 metres of any residential, institutional or commercial establishment, a railway company shall not shunt, couple or decouple cars or leave an engine with its motor idling
(a) at any time on a Saturday, Sunday, or legal holiday, and
(b) before 8:00 a.m. and after 10:00 p.m. on any other day,
except as authorized by the Minister of Transport for a specific period during a national emergency declared under the Emergencies Act.
