An Act to amend the Hazardous Products Act (plastic bags)
Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

HAZARDOUS PRODUCTS ACT
1. Section 6 of the Hazardous Products Act is amended by adding the following after subsection (2):
Exception
(2.1) Despite subsection (2), the Governor in Council may not amend Part I of Schedule I to delete item 43.
2. Part I of Schedule I to the Act is amended by adding the following after item 42:
43. Bags that are made of non-biodegradable plastic, including those made of low-density polyethylene and linear low-density polyethylene, and that are intended for single use for the purpose of carrying various items such as food and consumer goods from their point of purchase.

3. (1) Subsections (2) and (3) apply if Bill C-36, introduced in the 3rd session of the 40th Parliament and entitled An Act respecting the safety of consumer products (in this section referred to as the “other Act”), receives royal assent.
(2) On the first day on which both section 1 of this Act and section 73 of the other Act are in force, the other Act is amended by adding the following after subsection 37(1):
Exception
(1.1) Despite paragraph 37(1)(c), the Governor in Council may not amend Schedule 2 to delete item 16.
(3) On the first day on which both section 2 of this Act and section 75 of the other Act are in force, Schedule 2 to the other Act is amended by adding the following after item 15:
16. Bags that are made of non-biodegradable plastic, including those made of low-density polyethylene and linear low-density polyethylene, and that are intended for single use for the purpose of carrying various items such as food and consumer goods from their point of purchase.
