SUMMARY
This enactment amends the Criminal Code to give the owner or person in lawful possession of property the power to arrest without warrant a person he finds committing, or he believes has committed, a criminal offence on or in relation to that property.

Le texte modifie le Code criminel afin d’autoriser le propriétaire ou la personne en possession légitime d’un bien à arrêter sans mandat toute personne qu’il trouve en train de commettre une infraction criminelle sur ou concernant ce bien ou dont il croit qu’elle a commis une telle infraction.

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
Sa Majesté, sur l’avis et avec le consentement du Sénat et de la Chambre des communes du Canada, édicte :

1. The portion of subsection 494(2) of the Criminal Code after paragraph (b) is replaced by the following:
1. Le passage du paragraphe 494(2) du Code criminel suivant l’alinéa b) est remplacé par ce qui suit :
may, within a reasonable period, arrest without warrant a person whom he finds committing a criminal offence on or in relation to that property or a person who, on reasonable grounds, he believes has committed such an offence.
peut, dans un délai raisonnable, arrêter sans mandat toute personne qu’il trouve en train de commettre une infraction criminelle sur ou concernant ce bien ou dont il a des motifs raisonnables de croire qu’elle a commis une telle infraction.
