SUMMARY
This enactment amends the Fisheries Act to prevent the authorized deposit of substances from industrial processes relating to mining activities into any waters or place that would result in the alteration, disruption or destruction of fish habitat or degrade the ecological integrity of that habitat.

An Act to amend the Fisheries Act (mining activities)

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
1. Section 35 of the Fisheries Act is amended by adding the following after subsection (2):
Exception — mining activities
(3) Despite subsection (2), neither the Minister nor the Governor in Council may, under any conditions, authorize the alteration, disruption or destruction of fish habitat by the deposit of any waste or deleterious substance from an industrial process relating to mining activities in any water or place that would degrade the ecological integrity of fish habitat.
2. Section 36 of the Act is amended by adding the following after subsection (5):
Exception — mining activities
(5.1) The Governor in Council may not make regulations that allow a person to deposit or to permit the deposit of, in any water or place,
(a) a waste or pollutant from an industrial process relating to mining activities that would degrade the ecological integrity of fish habitat, despite any Act other than this Act or any regulations made under any other Act; or
(b) a deleterious substance from an industrial process relating to mining activities that would degrade the ecological integrity of fish habitat, despite subsection (5).
