An Act to prohibit sweatshop labour goods

Preamble

Whereas Canada is a member of the International Labour Organization (ILO);

Whereas the ILO provides support for improved working conditions through its integrated Decent Work Country Programmes developed in coordination with ILO constituents;

Whereas the bilateral and multilateral Agreements on Labour Cooperation to which Canada is a party have thus far provided neither internationally consistent rules nor effective enforcement mechanisms to ensure the observ- ance of core labour standards;

Whereas Canada considers the observance of core labour standards and the strengthening of national economies to be complementary, not competing, goals;

And whereas Canada recognizes that decent work is central to efforts to reduce poverty;

que l’OIT appuie l’amélioration des conditions de travail par l’entremise de ses programmes intégrés par pays de promotion du travail décent, élaborés en collaboration avec ses mandants;

que les accords bilatéraux et multilatéraux de coopération dans le domaine du travail auxquels le Canada est partie n’ont pas permis jusqu’à maintenant d’instaurer des règles uniformes à l’échelle internationale et des mécanismes de contrôle d’application efficaces en vue d’assurer le respect des normes fondamentales du travail;

que le Canada considère que le respect des normes fondamentales du travail et le renforcement des économies nationales constituent des objectifs complémentaires et non concurrents;

que le Canada reconnaît que le travail décent est au coeur des efforts déployés pour réduire la pauvreté,

Now, therefore, Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

SHORT TITLE

Short title

1. This Act may be cited as the Prohibition on Importing Goods Produced by Sweatshop Labour Act.

Definition of “Minister”

2. In this Act, “Minister” means such member of the Queen’s Privy Council for Canada as is designated by the Governor in Council as the Minister for the purposes of this Act.

2. Dans la présente loi, « ministre » s'entend du membre du Conseil privé de la Reine pour le Canada chargé par le gouverneur en conseil de l’application de la présente loi.

Addition to the List

3. (1) The Governor in Council may, on the recommendation of the Minister, make an order adding a good to the List of Prohibited Imports in the schedule, if the Governor in Council is satisfied that the good was produced, manufactured or assembled, in whole or in part, in contravention of the labour standards of the International Labour Organization, namely

(a) the right of association;

(b) the right to bargain collectively;

(c) the prohibition on the use of any form of forced or compulsory labour;

(d) a minimum age for employment of children; and

(e) acceptable conditions of work with respect to minimum wages, hours of work and occupational safety and health.

3. (1) Le gouverneur en conseil peut, par décret pris sur recommandation du ministre, inscrire une marchandise sur la Liste des importations interdites figurant à l’annexe s’il est convaincu que cette marchandise a été produite, fabriquée ou assemblée, en tout ou en partie, en contravention des normes du travail de l’Organisation internationale du Travail portant sur :

a) le droit d’association;

b) le droit de négociation collective;

c) l’interdiction de toute forme de travail forcé ou obligatoire;

d) l’âge minimum d’emploi des enfants;

e) les conditions de travail acceptables quant au salaire minimum, aux heures de travail et à la sécurité et à la santé au travail.

Deletion from the List

(2) The Governor in Council may, on the recommendation of the Minister and if satisfied that the inclusion of a good on the List of Prohibited Imports in the schedule is no longer necessary, make an order deleting the good from the List.

(2) S’il est convaincu qu’une marchandise n’a plus à figurer sur la Liste des importations interdites figurant à l’annexe, le gouverneur en conseil peut, par décret pris sur recommandation du ministre, la radier de la liste.

4. (1) Subject to subsection (2), no person shall import for sale in Canada goods that are set out on the List of Prohibited Imports in the schedule.

4. (1) Sous réserve du paragraphe (2), il est interdit d’importer pour la vente au Canada les marchandises énumérées dans la Liste des importations interdites figurant à l’annexe.

(2) A person may import goods referred to in subsection (1) if they are accompanied by a certificate attesting that they were produced, manufactured or assembled in compliance with the labour standards referred to in paragraphs 3(1)(a) to (e).

(2) Les marchandises visées au paragraphe (1) peuvent être importées si elles sont assorties d’un certificat attestant qu’elles ont été produites, fabriquées ou assemblées conformément aux normes du travail mentionnées aux alinéas 3(1)a) à e).

5. The Governor in Council may, on the recommendation of the Minister, make regulations

(a) establishing a method of identifying goods to be added to the List of Prohibited Imports;

(b) respecting the certification referred to in subsection 4(2); and

(c) identifying agencies qualified to provide certification for the purposes of the Act.

5. Sur recommandation du ministre, le gouverneur en conseil peut, par règlement :

b) régir la certification visée au paragraphe 4(2);

c) désigner les organismes qualifiés pour délivrer des certificats pour l’application de la présente loi.
