An Act to amend the War Veterans Allowance Act (allied veterans)

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. (1) Subsection 6.2(1) of the War Veterans Allowance Act is replaced by the following:

Continuation of allowance

6.2 (1) Subject to this Act, an allowance payable under section 4 or awarded under section 5, on or before February 27, 1995, to or in respect of a person who is an allied veteran within the meaning of paragraph 37(4)(b) or an allied dual service veteran within the meaning of subsection 37(6), as that paragraph and that subsection read immediately before that day, shall continue to be paid during the lifetime of the recipient and shall cease with the payment for the month in which the recipient dies.

6.2 (1) Sous réserve des autres dispositions de la présente loi, les allocations payées ou accordées en vertu des articles 4 ou 5 en date du 27 février 1995 pour un ancien combattant allié, au sens de l'alinéa 37(4)b), ou un ancien combattant allié à service double, au sens du paragraphe 37(6), en leur état avant cette date, continuent d'être versées jusqu'à la mort du bénéficiaire, le dernier paiement étant pour le mois de son décès.

(2) Subsection 6.2(3) of the Act is repealed.

Exceptions

(5) Notwithstanding subsection (4), a person to whom subsection (1) or (2) applies who

Allied dual service veteran

(6) An allied dual service veteran is a person who

(a) served during World War I as a member of His Majesty’s forces;

(b) was a member of His Majesty’s Canadian forces during World War II, enlisted or obligated to serve without territorial limitation; and

(c) has been honourably discharged or has been permitted honourably to resign or retire from those forces.

(6) Est un ancien combattant allié à service double toute personne qui, à la fois :

Anciens combattants alliés à service double

a) a servi pendant la Première Guerre mondiale comme membre des forces de Sa Majesté;

b) était membre des forces canadiennes de Sa Majesté pendant la Seconde Guerre mondiale, et était enrôlée pour servir, ou avait l'obligation de servir, sans limitation territoriale;

c) a été honorablement libérée de ces forces ou a reçu la permission d'en démissionner ou de s'en retirer honorablement.
