An Act to amend the Food and Drugs Act (trans fatty acids)
Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

FOOD AND DRUGS ACT
1. Section 2 of the Food and Drugs Act is amended by adding the following in alphabetical order:
trans fatty acids” means unsaturated fatty acids that contain one or more isolated or non-conjugated double bonds in a trans-configuration;
2. The Act is amended by adding the following after section 5:
Application
5.1 (1) This section applies to oils and fats, including emulsions with fat as the continuous phase, that are intended for human consumption.
Content of trans fatty acids in oils and fats
(2) No person shall sell to a consumer any oil or fat that contains more than 2 g of trans fatty acids per 100 g of oil or fat.
Content of trans fatty acids in other food
(3) No person shall sell to a consumer any food that contains one or more ingredients in addition to oil or fat if the food contains more than 2 g of trans fatty acids per 100 g of oil or fat in the food.
Exception
(4) This section does not apply to naturally occurring amounts of trans fatty acids that are contained in animal fats.
TRANSITIONAL PROVISION
Grace period
3. (1) During the period of two years after the coming into force of this Act, the references in section 5.1 to “2 g of trans fatty acids” shall be read as references to “5 g of trans fatty acids”.
Saving
(2) Products manufactured before the coming into force of this Act and products manufactured within a period of two years after the coming into force of this Act may be sold until the expiry of the “best before” date.
