An Act to amend the Canada Transportation Act (vibration and noise)
Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
1996, c. 10
1. (1) The portion of section 95.1 of the Canada Transportation Act before paragraph (a) is replaced by the following:

95.1 When constructing or operating a railway, a railway company must cause as little noise and vibration as possible, taking into account
(2) Section 95.1 of the Act is amended by striking out the word “and” at the end of paragraph (b), by adding the word “and” at the end of paragraph (c) and by adding the following after paragraph (c):
(d) the potential impact on persons residing in properties adjacent to the railway.
2. Subsection 95.3(1) of the Act is replaced by the following:
Complaints and investigations
95.3 (1) On receipt of a complaint made by any person that a railway company is not complying with section 95.1, the Agency may order the railway company to undertake any changes in its railway construction or operation that the Agency considers reasonable to cause as little noise or vibration as possible, taking into account factors referred to in that section.
