SUMMARY
This enactment amends the Criminal Code to prohibit a person from communicating with anyone for the purpose of procuring, attempting to procure or soliciting another person to commit a sexual offence, whether in or out of Canada.

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
Sa Majesté, sur l’avis et avec le consentement du Sénat et de la Chambre des communes du Canada, édicte :

1. (1) Subsection 212(1) of the Criminal Code is amended by adding the following after paragraph (a):
1. (1) Le paragraphe 212(1) du Code criminel est modifié par adjonction, après l’alinéa a), de ce qui suit :
(a.1) communicates with anyone for the purpose of procuring, attempting to procure or soliciting another person to commit a sexual offence whether in or out of Canada,
a.1) communique avec une personne dans le but d’induire, de tenter d’induire ou de solliciter une autre personne à commettre une infraction sexuelle, soit au Canada, soit à l’étranger;
(2) Section 212 of the Act is amended by adding the following after subsection (1):
(2) L’article 212 de la même loi est modifié par adjonction, après le paragraphe (1), de ce qui suit :
Meaning of “communicates”
(1.1) For the purposes of subsection (1), “communicates” means transmit, distribute, advertise or otherwise make available by any means.
(1.1) Pour l’application du paragraphe (1), « communiquer » s’entend du fait de transmettre, de distribuer, de publiciser ou de rendre disponible de toute autre façon.
