SUMMARY
This enactment amends the Motor Vehicle Safety Act to provide that every vehicle weighing less than 4 536 kilograms sold in Canada or imported into Canada is to be equipped with an electronic stability control (ESC) system.

An Act to amend the Motor Vehicle Safety Act (electronic stability control)

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada enacts as follows:
1. (1) Subsection 5(1) of the Motor Vehicle Safety Act is amended by adding the following after paragraph (a):
(a.1) in the case of a vehicle weighing less than four thousand five hundred and thirty-six kilograms (4 536 kg), the vehicle is equipped with an electronic stability control (ESC) system that uses automatic computer-controlled braking of individual wheels to assist the driver in maintaining control in critical driving situations;
(2) Section 5 of the Act is amended by adding the following after subsection (3):
Time and extent of compliance
(3.1) Every person who sells vehicles or equipment in Canada or imports vehicles or equipment into Canada shall satisfy the requirement of paragraph 5(1)(a.1) as set out below:
(a) within two years after this Act receives royal assent, in respect of 35% of the vehicles sold or imported;
(b) within three years after this Act receives royal assent, in respect of 50% of the vehicles sold or imported;
(c) within four years after this Act receives royal assent, in respect of 75% of the vehicles sold or imported;
(d) within five years after this Act receives royal assent, in respect of 95% of the vehicles sold or imported; and
(e) within six years after this Act receives royal assent, in respect of 100% of the vehicles sold or imported.
2. Section 6 of the Act is replaced by the following:
Compliance by all persons importing vehicles
6. No person shall import into Canada a vehicle of a prescribed class unless the requirements of paragraphs 5(1)(a), (b), (d) and (e) — and, in the case of a vehicle weighing less than four thousand five hundred and thirty-six kilograms (4 536 kg), paragraph (a.1) — are satisfied in respect of the vehicle.
