SUMMARY This enactment amends the Canadian Environmental Protection Act, 1999 to prohibit the use or sale in Canada and the import of dishwasher detergents and laundry detergents that contain phosphorus.		SOMMAIRE Le texte modifie la Loi canadienne sur la protection de l’environnement (1999), afin d’interdire l’utilisation ou la vente au Canada ainsi que l’importation de détergents à lessive ou détergents à vaisselle qui contiennent des phosphores.

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. The Canadian Environmental Protection Act, 1999 is amended by adding the following after section 117:

1. La Loi canadienne sur la protection de l’environnement (1999) est modifiée par adjonction, après l’article 117, de ce qui suit :

Prohibition of phosphorous		117.1 (1) No person shall
		(a) manufacture for use or sale in Canada a laundry detergent or a dishwashing detergent that contains phosphorus;
		(b) import a laundry detergent or a dishwashing detergent that contains phosphorus; or
		(c) sell a laundry detergent or a dishwashing detergent that contains phosphorus.

117.1 (1) Il est interdit :		Interdiction de phosphores
a) de fabriquer, pour utilisation ou vente au Canada, tout détergent à lessive ou détergent à vaisselle qui contient des phosphores;
b) d’importer un tel détergent;
c) de vendre un tel détergent.

Coming into force

(2) Paragraphs (1)(a) and (b) come into force 180 days after the day on which this Act receives royal assent.

(2) Les alinéas (1)a) et b) entrent en vigueur cent quatre-vingts jours après la date de sanction de la présente loi.

(3) Paragraph (1)(c) comes into force 360 days after the day on which this Act receives royal assent.

2. The portion of subsection 119(1) of the Act before paragraph (a) is replaced by the following:

119. (1) Where there is a contravention of section 117 or 117.1 or the regulations, the Minister may, in writing, direct a manufacturer or importer of a nutrient, cleaning product or water conditioner to take any or all of the following measures in the manner and within the period directed by the Minister:

(1) En cas de contravention aux articles 117 ou 117.1 ou aux règlements, le ministre peut, par écrit, ordonner aux fabricants ou importateurs de substances nutritives, de produits de nettoyage ou de conditionneurs d'eau de prendre, selon les instructions et dans le délai prévus, tout ou partie des mesures suivantes :
