An Act to amend the Canada Elections Act (identity of electors)
2000, c. 9
Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
1. (1) Subsection 143(1) of the Canada Elections Act is replaced by the following:
Elector to declare name with face uncovered
143. (1) Each elector, on arriving at the polling station, shall, with his or her face uncovered, give his or her name and address to the deputy returning officer and the poll clerk, and, on request, to a candidate or his or her representative.
(2) Paragraph 143(2)(b) of the Act is replaced by the following:
(b) if the elector does not possess any piece of identification described in paragraph (a), two pieces of identification authorized by the Chief Electoral Officer each of which establish the elector’s name and at least one of which establishes the elector’s address.
(3) Paragraph 143(3)(a) of the Act is replaced by the following:
(a) identifies himself or herself in accordance with subsections (1) and (2); and
2. The portion of subsection 161(1) of the Act before paragraph (a) is replaced by the following:
Registration in person
161. (1) An elector whose name is not on the list of electors may register in person on polling day if the elector, with his or her face uncovered,
3. Paragraph 162(g) of the Act is replaced by the following:
(g) indicate, if applicable, on the prescribed form that the elector refused to comply with a legal requirement set out in subsection 143(1), or a legal requirement to provide the piece or pieces of identification referred to in paragraph 143(2)(a) or (b), respectively, or to take an oath;
4. The portion of subsection 169(2) of the Act before paragraph (a) is replaced by the following:
Conditions
(2) An elector shall not be registered unless he or she gives his or her name and address in accordance with subsection 143(1) and
5. Section 241 of the Act is replaced by the following:
Elector to be given regular ballot
241. An elector who applies to vote in person at the office of the returning officer for his or her electoral district after ballots for the electoral district have been printed shall be given a ballot that is not a special ballot and, after complying with subsection 143(1), shall immediately vote in the manner described in paragraphs 151(1)(a) and (b) and 227(2)(b) to (d) and return the outer envelope to the election officer.
