Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
|
|
|
|

1. Subsection 118.2(2) of the Income Tax Act is amended by adding the following after paragraph (n):
|
|
|
|
1. Le paragraphe 118.2(2) de la Loi de l’impôt sur le revenu est modifié par adjonction, après l’alinéa n), de ce qui suit :
|
|
|
|
|
|
(n.1) for any herbal remedy that is
|
|
|
(i) purchased for use by a patient who has been certified by a medical practitioner to have a severe allergy or a severe sensitivity to a drug, medicament or other preparation or substance described in paragraph (n), and
|
|
|
(ii) prescribed by a medical practitioner as a substitute for that drug, medicament or other preparation or substance;
|
|
|
|
n.1) pour les produits de phytothérapie qui :
|
|
|
|
(i) d’une part, sont achetés afin d’être utilisés par le particulier, son époux ou conjoint de fait ou une personne à charge visée à l’alinéa a) qui, d’après l’attestation d’un médecin, souffre d’une allergie grave ou d’une intolérance à un médicament, un produit pharmaceutique ou toute autre préparation ou substance visés à l’alinéa n),
|

|
|
(ii) d’autre part, sont prescrits par le médecin à titre de substitut de ce médicament, de ce produit pharmaceutique ou de cette préparation ou substance;
|
|
|
|
|
|
2. Subsection 221(1) of the Act is amended by adding the following after paragraph (a):
|
|
|
|
2. Le paragraphe 221(1) de la même loi est modifié par adjonction, après l’alinéa a), de ce qui suit :
|
|
|
|
|
|
(a.1) defining “herbal remedy” for the purposes of paragraph 118.2(2)(n.1);
|
|
|
|
a.1) définir « produits de phytothérapie » pour l’application de l’alinéa 118.2(2)n.1);
|
