An Act to amend the Public Service Employment Act (priority for appointment for veterans)
Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

PUBLIC SERVICE EMPLOYMENT ACT
1. (1) Section 41 of the Public Service Employment Act is amended by adding the following after subsection (1):
Priority — Canadian Forces
(1.1) Priority for appointment over all other persons shall be given to
(a) a member of the Canadian Forces who for a cumulative period of at least 36 months has served in a special duty area, for a period of one year after they cease to be a member of the Canadian Forces; or
(b) the survivor of a member of the Canadian Forces described in paragraph (a), for a period of one year after the member ceased to be a member of the Canadian Forces.
(2) Section 41 of the Act is amended by adding the following after subsection (6):

(7) The following definitions apply in this section.
“special duty area”

“special duty area” means an area designated as a special duty area under section 69 of the Canadian Forces Members and Veterans Re-establishment and Compensation Act.
“survivor”

« survivant »
“survivor”, in relation to a member of the Canadian Forces, means
(a) a person who was married to the member at the time of the member’s death, if there is no person described in paragraph (b); or
(b) a person who was cohabiting with the member in a conjugal relationship for a period of at least one year immediately before the member’s death.
TRANSITIONAL PROVISION
Priorities
2. Every person who has a priority for appointment under the Public Service Employment Act on the coming into force of this Act continues to have priority for appointment for the period, and in the order, provided for by or under that Act.
