An Act to amend the Canada Labour Code (minimum wage)

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. Subsection 178(1) of the Canada Labour Code is replaced by the following:

1. Le paragraphe 178(1) du Code canadien du travail est remplacé par ce qui suit :

Minimum wage

178. (1) Except as otherwise provided by or under this Division, an employer shall pay to each employee a wage at a rate that is not less than the greater of

(a) the minimum hourly rate fixed, from time to time, by or under an Act of the legislature of the province where the employee is usually employed and that is generally applicable regardless of occupation, status or work experience; and

(b) ten dollars per hour.

178. (1) Sauf disposition contraire de la présente section, l’employeur doit payer à chaque employé au moins le plus élevé des salaires horaires suivants :

a) soit le salaire horaire minimum au taux fixé et éventuellement modifié en vertu de la loi de la province où l'employé exerce habituellement ses fonctions, et applicable de façon générale, indépendamment de la profession, du statut ou de l'expérience de travail;

b) soit dix dollars l’heure.

Where wage rate not hourly

(1.1) Where the wages of an employee are paid on any basis of time other than hourly, the employer shall pay to the employee a wage at a rate that is not less than the equivalent of the applicable rate under subsection (1) for the time worked by the employee.

(1.1) Quand la base de calcul du salaire n'est pas l'heure, l’employeur doit payer à chaque employé, en fonction du temps travaillé, un taux au moins équivalent à celui établi au paragraphe (1).
