Sommaire

This enactment amends the Employment Insurance Act to allow employees to receive, every year, up to five weeks of training directed at the development of their careers.

Le texte modifie la Loi sur l’assurance-emploi afin de permettre aux employés de bénéficier chaque année d’un maximum de cinq semaines de formation en vue du perfectionnement professionnel.

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

Sa Majesté, sur l’avis et avec le consentement du Sénat et de la Chambre des communes du Canada, édicte :

1. The Employment Insurance Act is amended by adding the following after section 59:

1. La Loi sur l’assurance-emploi est modifiée par adjonction, après l’article 59, de ce qui suit :

Provision of training

59.1 (1) The Commission shall provide training for insured persons in accordance with this section.

59.1  (1) La Commission fournit de la formation aux assurés conformément au présent article.

Training entitlement

(2) An insured person who makes a request to their employer to receive training under this section is entitled to receive training that

(a) meets the requirements set out in subsection (3);

(b) does not exceed 5 weeks for every year that the person has been an insured person with the employer;

(c) does not exceed 52 weeks as an aggregate life-time entitlement; and

(d) conforms to the regulations.

(2) L’assuré qui en a fait la demande à son employeur a le droit de recevoir une formation :

a) qui satisfait aux conditions énoncées au paragraphe (3);

b) dont la durée maximale est de cinq semaines par année d’emploi de l’assuré auprès de cet employeur;

c) dont la durée maximale durant sa vie est de cinquante-deux semaines;

d) qui est conforme aux règlements.

Admissibilité à la formation

Appropriate training

(3) Training provided under this section shall

(a) be appropriate for the insured person’s experience  and education;

(b) be directed at providing skills that are relevant to the employment and advancement opportunities that are or are likely to become available to the insured person with their employer; and

(c) reflect the career objectives of the insured person.

(3) La formation offerte doit :

a) être adaptée à l’assuré en fonction de son expérience et de son niveau de scolarité;

b) viser l’acquisition d’habiletés pertinentes à son emploi et à ses possibilités de promotion actuelles ou éventuelles auprès de son employeur;

c) tenir compte de ses objectifs de carrière.

Regulations

(4) The Commission may, with the approval of the Governor in Council, make regulations  for the purposes of subsections (1), (2) and (3).

(4) La Commission peut, avec l’agrément du gouverneur en conseil, prendre des règlements pour l’application des paragraphes (1), (2) et (3).
