Sommaire

This enactment is designed to remedy the situation where a person has, as a child, been deprived of their Canadian citizenship as a result of the operation of section 18 of the The Canadian Citizenship Act, chapter 15 of the Statutes of Canada, 1946. That provision, which was in force until February 14, 1977, provided that a minor child ceased to be a citizen upon their responsible parent becoming the citizen of another country. This enactment makes it easier for such a person to regain their Canadian citizenship as they will no longer have to be established as a permanent resident in order to do so.

Le texte vise à remédier à la situation d’une personne qui, dans son enfance, a perdu la citoyenneté canadienne par application de l’article 18 de la Loi sur la citoyenneté canadienne, chapitre 15 des Statuts du Canada de 1946. Selon cette disposition, en vigueur jusqu’au 14 février 1977, un enfant mineur perdait la citoyenneté lorsque le parent responsable devenait citoyen d’un autre pays. Le texte facilite la réintégration d’une telle personne dans la citoyenneté canadienne puisqu’elle n’a plus à être un résident permanent avant d’en faire la demande.

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

Sa Majesté, sur l’avis et avec le consentement du Sénat et de la Chambre des communes du Canada, édicte :

1. Section 11 of the Citizenship Act is amended by adding the following after subsection (1):

1. L’article 11 de la Loi sur la citoyenneté est modifié par adjonction, après le paragraphe (1), de ce qui suit :

Exception

(1.1) The requirement set out in paragraph (1)(d) does not apply to a person who ceased to be a citizen before February 15, 1977, because a parent of that person ceased to be a citizen as a result of

(a) acquiring the nationality or citizenship of a country other than Canada; or

(b) renouncing his or her Canadian citizen- ship.

(1.1) L’exigence prévue à l’alinéa (1)d) ne s’applique pas à la personne qui a perdu la citoyenneté avant le 15 février 1977, parce qu’un de ses parents a cessé d’être citoyen du fait qu’il a :

a) soit acquis la nationalité ou la citoyenneté d’un pays autre que le Canada;

b) soit répudié sa citoyenneté canadienne.
