Summary
This enactment amends the Fisheries Act to expressly provide that a breach of a term or condition of a permission granted under section 4 of the Act or of a licence or lease issued under the Act is an offence. It defines “aboriginal organization” and provides express regulation-making authority for designating persons who may fish and vessels that may be used to fish under a licence issued to an aboriginal organization and for authorizing designations to be made through licence conditions. The enactment also provides that the terms and conditions of some licences issued to aboriginal organizations prevail over certain regulations, to the extent of any inconsistency.

Le texte modifie la Loi sur les pêches pour prévoir expressément qu’une violation des conditions d’une permission accordée en vertu de l’article 4 de cette loi ou d’un bail, d’un permis ou d’une licence consentis sous le régime de la même loi constitue une infraction. Il ajoute une définition de « organisation autochtone » et prévoit expressément un pouvoir réglementaire concernant la désignation des personnes autorisées à pêcher et des bateaux de pêche qui peuvent être utilisés au titre d’un permis délivré à une telle organisation et autorisant de telles désignations à titre de conditions du permis. Le texte prévoit en outre que les conditions de certaines catégories de permis délivrés à une organisation autochtone l’emportent sur toute disposition incompatible de certains règlements.

10. (1) Every one acting under the authority of a permission granted under section 4 or of a lease or licence issued under this Act shall comply with its terms and conditions.

(2) For greater certainty, written permissions, licences and leases issued under this Act, and the terms and conditions of those permissions, licences and leases, are not statutory instruments within the meaning of the Statutory Instruments Act.

Terms and conditions of certain licences prevail
|
11. In the event of an inconsistency between the terms and conditions of a licence of a type prescribed by regulation under paragraph 43(g.03) that is issued to an aboriginal organization and the provisions of regulations included in a list established under that paragraph, the terms and conditions of the licence prevail to the extent of the inconsistency.

Clause 3: (1) and (2) The relevant portion of section 43 reads as follows:
43. The Governor in Council may make regulations for carrying out the purposes and provisions of this Act and in particular, but without restricting the generality of the foregoing, may make regulations

4. The provisions of this Act come into force on a day or days to be fixed by order of the Governor in Council.
