Sommaire

 This enactment amends section 161 of the Criminal Code. Where an offender is convicted of a sexual offence, the enactment permits the court to make an order prohibiting the offender from being in a dwelling-house where the offender knows or ought to know that a person under the age of fourteen years is present and that the person who has custody or control of the person under the age of fourteen years is not present.

Le texte modifie l’article 161 du Code criminel. Dans le cas où un contrevenant est déclaré coupable d’une infraction de nature sexuelle, le texte permet au tribunal de lui interdire de se trouver dans une maison d’habitation où le contrevenant sait ou devrait savoir qu’il s’y trouve une personne de moins de quatorze ans, sans la présence de la personne ayant la garde ou la surveillance de la personne âgée de moins de quatorze ans.

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. Subsection 161(1) of the Criminal Code is amended by adding the following after paragraph (a):

1. Le paragraphe 161(1) du Code criminel est modifié par adjonction, après l’alinéa a), de ce qui suit :

(a.1) being in a dwelling-house where the offender knows or ought to know that a person under the age of fourteen years is present and that the person who has custody or control of the person under the age of fourteen years is not present;

a.1) de se trouver dans une maison d’habi-tation où le contrevenant sait ou devrait savoir qu’il s’y trouve une personne de moins de quatorze ans, sans la présence de la personne ayant la garde ou la surveillance de la personne âgée de moins de quatorze ans;
