Summary

Sommaire

 The purpose of this enactment is to legally define the word “marriage”. Marriage is defined as being a union between one man and one woman as husband and wife. Also, this enactment will protect the legal definition of “marriage” from challenge in the courts under the Canadian Charter of Rights and Freedoms.

Le texte a pour objet de définir juridiquement le mot « mariage » comme étant l’union d’un homme et d’une femme en tant qu’époux. De plus, le texte aura pour effet de protéger la définition juridique de « mariage » des contestations devant les tribunaux en vertu de la Charte canadienne des droits et libertés.

Preamble

 Whereas marriage, as defined between one man and one woman, has from time immemorial been firmly grounded in our legal tradition, one that is itself a reflection of long standing community values;

 Whereas the preservation of marriage as an institution is a matter of deep public concern and interest to the Canadian public, for it is the foundation of family and society;

 Whereas the solemnization of marriage honours these principles;

 And Whereas the people of Canada wish to provide and protect a legal definition of “marriage” that will not be challenged in the courts under the Canadian Charter of Rights and Freedoms;

Now, Therefore, Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

que le mariage, tel qu’il est défini, soit entre un homme et une femme, est depuis des temps immémoriaux fermement enraciné dans notre tradition juridique, qui elle-même est le reflet de valeurs traditionnelles de la société;

que la sauvegarde du mariage en tant qu’institution est une question qui préoccupe et intéresse profondément les Canadiens, parce qu’il est le fondement de la famille et de la société;

que la célébration du mariage honore ces principes;

que les Canadiens souhaitent prévoir une définition juridique de « mariage » qui ne sera pas contestée devant les tribunaux en vertu de la Charte canadienne des droits et libertés et la protéger,
