An Act to amend the Criminal Code (fire fighters)

R.S., c. C-46

      Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. Section 2 of the Criminal Code is amended by adding the following in alphabetical order:

``fire fighter''
« pompier »

``fire fighter'' means any person employed in, or appointed or assigned to, a fire department.

2. Subsection 231(4) of the Act is amended by striking out the word ``or'' at the end of paragraph (b), by adding the word ``or'' at the end of paragraph (c) and by adding the following after paragraph (c):

    (d) a fire fighter acting in the course of his or her duties.

3. (1) Section 268 of the Act is amended by adding the following after subsection (1):

Aggravated assault

(1.1) Every one commits an aggravated assault who wounds, maims, disfigures or endangers the life of a fire fighter acting in the course of his or her duties.

(2) Section 268 of the Act is amended by adding the following after subsection (2):

Punishment

(2.1) Every one who commits an aggravated assault under subsection (1.1) is guilty of an indictable offence and liable to imprisonment for a term not exceeding ten years.

4. The Act is amended by adding the following after section 433:

Arson-disre gard for human life

433.1 Every person who intentionally or recklessly causes damage by fire or explosion to property, whether or not that person owns the property, is guilty of an indictable offence and liable to imprisonment for life where the fire or explosion causes death or bodily harm to a fire fighter who is acting in response to the fire or explosion.

Minimum punishment

433.2 For the purposes of Part XXIII, the sentence of imprisonment for life prescribed by section 433.1 is a minimum punishment.
