An Act to amend the Criminal Code (wearing
of war decorations)
|

R.S., c. C-46
|

1. (1) Section 419 of the Criminal Code is
renumbered as subsection 419(1) and is
amended by adding the following:
|

Exception
|
(2) No person who is a relative of a deceased
veteran commits an offence under paragraph
(1)(b) where the person wears, on the right
side of the person's chest, a distinctive mark
relating to wounds received or service
performed in war by that veteran or wears, on
the right side of the person's chest, a military
medal, ribbon, badge, chevron or any
decoration or order that is awarded to that
veteran for war services and the person does so
on Remembrance Day.

Definition
|
(3) In subsection (2), ``veteran'' has the
meaning assigned in section 2 of the War
Veterans Allowance Act.

Person
commits
offence if in
uniform
|
(4) Despite subsection (2), a person who is
a relative of a deceased veteran commits an
offence under paragraph (1)(b) where the
person wears a distinctive mark or a military
medal, ribbon, badge, chevron, decoration or
order described in that paragraph while
wearing, with lawful authority, a uniform of
the Canadian Forces or any other navy, army
or air force.
