An Act to amend the Criminal Code (impaired driving causing death or injury)

R.S., c. C-46

      Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. The portion of subsection 254(3) of the Criminal Code before paragraph (a) is replaced by the following:

Samples of breath or blood

(3) Where a peace officer believes on reasonable and probable grounds that a person is committing, or at any time within the preceding three hours has committed, as a result of the consumption of alcohol, an offence under section 253, or that the person was involved in an accident resulting in the death of another person or in bodily harm to himself or herself or to any other person, the peace officer may, by demand made to that person forthwith or as soon as practicable, require that person to provide then or as soon thereafter as is practicable
