An Act respecting the posting of fuel prices by retailers

      Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

SHORT TITLE

Short title

1. Fuel Price Posting Act.

DEFINITIONS

2. The following definitions apply in this Act.

``fuel''
« carburant »

``fuel'' means

    (a) diesel fuel, including any fuel oil that is suitable for use in internal combustion engines of the compression-ignition type, other than such fuel oil that is intended for use and is actually used as heating oil;

    (b) gasoline type fuels for use in internal combustion engines other than aircraft engines, and includes ethanol and methanol; and

    (c) propane gas.

``retailer''
« détaillant »

``retailer'' means a person who is engaged in a business that includes the sale of fuel to consumers.

3. Where a retailer causes a poster, label or sign to be posted indicating the selling price for a fuel, the price shall be indicated without regard to any taxes imposed on the consumer by an Act of Parliament or an Act of the legislature of a province.

OFFENCE AND PUNISHMENT

Offence and punishment

4. (1) Every retailer who contravenes section 3 is guilty of an offence and is liable on summary conviction

    (a) for a first offence, to a fine not exceeding $1,000; and

    (b) for a subsequent offence, to a fine not exceeding $3,000.

Continuing offence

(2) Where an offence under subsection (1) is committed on more than one day, it shall be deemed to be a separate offence for each day on which the offence is committed or continued.

COMING INTO FORCE

Coming into force

5. This Act shall come into force one month after the day on which it is assented to.
