SUMMARY

The purpose of this amendment is to permit a referendum and a general election to be conducted at the same time and on the same polling day.

Subsections 6(6) and (7) of the Referendum Act, as amended, provide that, where the writs of election at a general election are issued during the period beginning on the day on which writs of referendum are issued and ending on polling day at the referendum, the Governor in Council may, by order, withdraw the writs of referendum within ten days after the writs of election are issued. However, where such writs of a general election are issued and the Governor in Council does not withdraw the writs of referendum within the ten-day period, the writs of referendum would remain in effect and subsection 6(8) of the Referendum Act, as amended, provides that the polling day at the referendum specified in the writs of referendum is deemed to be the polling day at the general election.

Also, as a consequence of the amendment of subsections 6(6) and (7), appropriate changes have been made to other sections of the Referendum Act. These changes relate to the definition of electoral districts, notice of withdrawal of writs or change of polling date, appointment of deputy returning officers and poll clerks, provision of lists of electors and time limits and allocation of time in respect of referendum broadcasts.
