SUMMARY

The purpose of this enactment is to ensure that no persons will be admitted to Canada as visitors, immigrants or refugees unless they have first provided satisfactory evidence of identity to an immigration officer. If the immigration officer determines that there is no satisfactory evidence of identity, the matter may be appealed to a senior immigration officer whose decision on the matter is final and not subject to further appeal.

A senior immigration officer may order that the requirement not apply to a claimant for refugee status if the circumstances made it impossible or impracticable to bring such evidence and may make such order subject to conditions relating to the later determination of identity. If such conditions are breached the order may be cancelled.

The demand to show identity must be made within seven days of arrival in Canada and an appeal to a senior immigration officer must be settled within a further seven days.
