1. (1) The definition ``head'' in section 3
of the Access to Information Act is amended
by striking out the word ``or'' at the end of
paragraph (a) and adding the following
after that paragraph:
|
|
|
|
|
|
|
|
(2) Section 3 of the Act is amended by
adding the following in alphabetical order:
|
|
| ``Canadian
Wheat
Board'' « Commission canadienne du blé »
|
``Canadian Wheat Board'' means the
Canadian Wheat Board continued by
section 3 of the Canadian Wheat Board
Act;
|
|
|
|
2. Section 4 of the Act is amended by
adding the following after subsection (1):
|
|
| Records of the
Canadian
Wheat Board
|
(1.1) Subsection (1) does not apply to any of
the following records controlled by the
Canadian Wheat Board until the record has
been in existence for more than two years.
|
|
|
|
|
|
|
|
|
|
|
|
|
|
|
|
|
|
|
|
|
|
|
|
|
|
|
|
|
|
|
|
|
|
|
|
|
|
|
|
|
|
|
|
3. Section 18 of the Act is renumbered as
subsection 18(1) and is amended by adding
the following:
|
|
| Presumption
|
(2) Where a person makes a request under
this Act for a record controlled by the
Canadian Wheat Board and that record has
been in existence for more than two years, the
disclosure of the information contained in the
record is deemed not to prejudice the
competitive position of the Board for the
purposes of paragraph (1)(b).
|
|
|
|
4. Schedule I to the Act is amended by
adding the following in alphabetical order
under the heading ``Other Government
Institutions'':
|
