An Act to amend the Farm Income Protection Act (crop damage by gophers)

1991, c. 22; 1994, c. 38; 1999, c. 17

      Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. Subsection 4(2) of the Farm Income Protection Act is amended by adding the following after paragraph (b):

    (b.1) where a farmer's ability to use a product that has previously been commonly used to protect a crop from damage by pests is limited by law on environmental, wildlife protection, safety or other grounds, the loss that results should be compensated;

2. The Act is amended by adding the following after section 8 of the Act:

Gopher damage

8.1 An agreement that provides for a crop insurance program shall include provision for insurance for damage caused by gophers in areas where the control of gophers has been limited as a result of restrictions on the use of products that have previously been commonly used to control gophers on the grounds of environmental or wildlife protection;
