SUMMARY |

This enactment provides for the transfer, by court order, on
application by the Crown, of a foreign offender serving a sentence of ten
years or more, to a country of which the offender is a citizen and that
consents to accept the offender. Transfer on Crown application may
only be made to countries that provide similar rights of conditional
release to those extant in Canada.

This is in addition to the present provisions that allow a foreign
offender to make an application to the Minister for such a transfer.
