CHAPTER 31

An Act to correct certain anomalies, inconsistencies and errors and to deal with other matters of a non-controversial and uncomplicated nature in the Statutes of Canada and to repeal certain Acts that have ceased to have effect

[Assented to 17th June, 1999]

      Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

SHORT TITLE

Short title

1. This Act may be cited as the Miscellaneous Statute Law Amendment Act, 1999.

PART 1

AMENDMENTS

R.S., c. A-1

Access to Information Act

2. Schedule I to the Access to Information Act is amended by striking out the following under the heading ``Other Government Institutions'':

Public Works Lands Company Limited

    Société immobilière des travaux publics limitée

3. Schedule I to the Act is amended by adding the following in alphabetical order under the heading ``Other Government Institutions'':

Canada Lands Company Limited

    Société immobilière du Canada limitée

Aeronautics Act

R.S., c. 33 (1st Supp.), s. 1

4. (1) Paragraph (a) of the definition ``superior court'' in subsection 3(1) of the Aeronautics Act is replaced by the following:

      (a) in the Provinces of Prince Edward Island and Newfoundland, the trial division of the Supreme Court of the Province,

      (a.1) in the Province of Ontario, the Superior Court of Justice,

(2) Paragraph (d) of the definition ``superior court'' in subsection 3(1) of the Act is replaced by the following:

      (d) in the Provinces of Nova Scotia and British Columbia, the Supreme Court of the Province, and

5. (1) The definition ``security officer'' in subsection 4.7(1) of the Act is repealed.

(2) Subsection 4.7(1) of the Act is amended by adding the following in alphabetical order:

``screening officer''
« agent de contrôle »

``screening officer'' means any person that may be designated by the Minister to be a screening officer for the purposes of this section.

Replacement of ``security officer'' with ``screening officer''

6. The Act is amended by replacing the words ``security officer'' with the words ``screening officer'' in subsections 4.7(5) to (8).

Anti-Personnel Mines Convention Implementation Act

7. The portion of subsection 21(1) of the Anti-Personnel Mines Convention Implementation Act before paragraph (a) is replaced by the following:

Punishment

21. (1) Every person who contravenes section 6 or 8 or subsection 13(3) or 17(1) is guilty of an offence and liable

Auditor General Act

1995, c. 43, s. 2

8. Paragraph (c) of the definition ``category I department'' in section 2 of the Auditor General Act is replaced by the following:

      (c) any department set out in the schedule;

Bank Act

9. Paragraph 55(1)(a) of the Bank Act is replaced by the following:

    (a) hold assets that banks are not otherwise permitted by this Act to hold if such assets consist of shares of a body corporate incorporated by or under an Act of Parliament or of the legislature of a province that, at the time application for letters patent incorporating the foreign bank subsidiary was made, were held by the eligible foreign institution, within the meaning of Part VII, that is the holding body corporate of the foreign bank subsidiary or any affiliate of that eligible foreign institution, and

10. Subsection 85(2) of the Act is replaced by the following:

Fee for security certificate

(2) A bank may charge a fee, not exceeding a prescribed amount, for a security certificate issued in respect of a transfer.

11. Paragraphs 275(1)(e) and (f) of the Act are replaced by the following:

    (e) exempting any class of distributions from the application of sections 273, 274 and 276 to 282; and

    (f) generally, for carrying out the purposes and provisions of sections 273, 274 and 276 to 282.

12. Subsection 276(1) of the Act is replaced by the following:

Order of exemption

276. (1) On application by a bank or any person proposing to make a distribution, the Superintendent may, by order, exempt that distribution from the application of sections 273, 274 and 277 to 282 if the Superintendent is satisfied that the bank has filed or is about to file, in compliance with the laws of the relevant jurisdiction, a prospectus relating to the distribution that, in form and content, substantially complies with the requirements of this Act and any regulations made under subsection 275(1).

13. Subsection 325(4) of the French version of the Act is replaced by the following:

Dépenses

14. Section 457 of the Act and the heading before it are repealed.

15. Subparagraph 518(3)(a)(iii) of the French version of the Act is replaced by the following:

      (iii) soit à exercer les fonctions d'agent de change, de courtier en valeurs, de conseiller en placement ou de gestionnaire de portefeuille,

16. Paragraph 559(g) of the French version of the Act is replaced by the following:

Bankruptcy and Insolvency Act

17. (1) Paragraph (d) of the definition ``date of the initial bankruptcy event'' in subsection 2(1) of the Bankruptcy and Insolvency Act is replaced by the following:

      (d) the first petition for a receiving order against the person, in any case

        (i) referred to in paragraph 50.4(8)(a) or 57(a) or subsection 61(2), or

        (ii) where a notice of intention to make a proposal has been filed under section 50.4 or a proposal has been filed under section 62 in respect of the person and the person files an assignment before the court has approved the proposal, or

(2) Paragraph (e) of the definition ``ouverture de la faillite'' in subsection 2(1) of the French version of the Act is replaced by the following:

18. Paragraph 14.03(1)(d) of the English version of the Act is replaced by the following:

    (d) direct the official receiver not to appoint the trustee in respect of any new estates until a decision is made under subsection 13.2(5) or 14.01(1).

19. Subsection 51(3) of the French version of the Act is replaced by the following:

21. Paragraph 66.13(2)(b) of the English version of the Act is replaced by the following:

    (b) provide, or provide for, counselling in accordance with directives issued by the Superintendent pursuant to paragraph 5(4)(b);

22. Subsection 77(1) of the French version of the Act is replaced by the following:

Actionnaires contributaires

77. (1) Tout actionnaire ou membre d'une personne morale en faillite est tenu de verser le montant impayé de ses actions du capital ou de ses engagements envers la personne morale ou envers ses membres ou créanciers, selon le cas, sous le régime de la loi, de la charte ou de l'acte constitutif de la compagnie, ou autrement.

23. (1) Paragraph 81.1(1)(c) of the French version of the Act is replaced by the following:

(2) Subsection 81.1(3) of the Act is repealed.

24. Subsection 109(7) of the French version of the Act is replaced by the following:

Exception

(7) Un créancier qui n'a pas droit de voter à une assemblée des créanciers en raison du paragraphe (6) peut, avec l'autorisation du tribunal, voter à l'assemblée des créanciers lorsque tous les créanciers qui ont traité sans lien de dépendance avec le débiteur ne représentent pas ensemble au moins vingt pour cent en valeur des réclamations contre le débiteur.

25. Subsection 128(1) of the Act is replaced by the following:

Proof may be requested

128. (1) Where the trustee has knowledge of property that may be subject to a security, the trustee may, by serving notice in the prescribed form and manner, require any person to file, in the prescribed form and manner, a proof of the security that gives full particulars of the security, including the date on which the security was given and the value at which that person assesses it.

26. Paragraph 155(d) of the Act is replaced by the following:

    (d) all notices, statements and other documents shall be sent by ordinary mail or by any prescribed manner;

Bretton Woods and Related Agreements Act

27. Section 9 of the Bretton Woods and Related Agreements Act is repealed.
