An Act to amend the Parliament of Canada Act (meetings of the Board of Internal Economy)

      Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. The Parliament of Canada Act is amended by adding the following after section 52.9:

Members attending

52.10 (1) Any member of the House of Commons who is not a member of the Board may attend a meeting of the Board, other than a meeting or any part of a meeting that is held in closed session, and may, subject to the directions of the Speaker, speak at the meeting but may not vote nor move a motion.

(2) The Board, where it considers it appropriate, may permit a member of the House of Commons who is not a member of the Board to attend a meeting of the Board that is held in closed session, or a part of such a meeting, if

    (a) the matter under discussion affects the member particularly and not only in common with all other members; or

    (b) the Board wishes to hear the member on a matter.

Oath or affirmation of secrecy

(3) The Board may require a member permitted to attend a meeting pursuant to subsection (2) to take an oath or affirmation of secrecy in the form set out in Form 4 of the schedule.

Member speaking to the Board

(4) The Board may, pursuant to paragraph 52.5(1)(a), make by-laws limiting the time for which a member of the House of Commons who is not a member of the Board may speak at a meeting of the Board, the number of times such a member may speak on a matter and the number of such members who may speak on one matter.

Board meetings open

52.11 (1) The meetings of the Board must be open to the public.

Closed sessions

(2) Notwithstanding subsection (1), prior to considering a matter relating to security, employment and staff relations, tenders or investigations in relation to a member of the House of Commons, the Board may determine by resolution to consider the matter in closed session.

Minutes

52.12 (1) The Board shall keep minutes of its proceedings that shall describe every matter taken under consideration and every decision, action or order of the Board resulting from its consideration of the matter.

Publication of minutes

(2) The Board shall make public the minutes of every meeting within two days of the meeting.

Closed session minutes

(3) Subsection (2) does not apply to minutes of a meeting or part of a meeting held in closed session pursuant to subsection 52.11(2).

Schedule

2. The heading of the schedule to the Act is replaced by the following:

3. The schedule to the Act is amended by adding the following after Form 3:

FORM 4

I, .........., do solemnly swear (affirm) that I will not communicate or allow to be communicated to any person any matter relating to employment and staff relations, tenders, security or investigations in relation to a member of the House of Commons that comes to my knowledge during a meeting of the Board held in closed session. (In the case where an oath is taken, add ``So help me God'').
