	An Act to amend the Marriage (Prohibited Degrees) Act (marriage between persons of the same sex)
1990, c. 46	Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
	*1. The title of the Marriage (Prohibited Degrees) Act* is replaced by the following:**
	An Act respecting the capacity to marry
	2. Section 1 of the Act is replaced by the following:
	1. This Act may be cited as the Marriage Capacity Act.
	3. The Act is amended by adding the following after section 4:
Same sex parties	4.1 A marriage between two persons is not invalid by reason only that they are of the same sex.
