An Act to amend the Canadian Wheat Board Act (audit)

R.S., c. C-24; R.S., cc. 37, 38 (4th Supp.); 1988, c. 65; 1991, cc. 33, 46, 47; 1993, c. 44; 1994, cc. 39, 47; 1995, c. 31

      Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

SHORT TITLE

Short title

1. This Act may be cited as the Canadian Wheat Board Annual Audit Act.

2. The Canadian Wheat Board Act is amended by adding the following after section 8:

Audit of Accounts and Records

Annual audit by Auditor General

8.1 (1) The accounts and records of the Board shall be audited annually by the Auditor General of Canada and a report of the audit shall be made to the Board and the Minister.

Report to Parliament

(2) The Minister shall cause the report made under subsection (1) to be laid before each House of Parliament on any of the first fifteen days on which that House is sitting after the report is received by the Minister.

3. (1) Paragraph 9(1)(b) of the Act is repealed.

(2) Paragraph 9(1)(c) of the Act is replaced by the following:

    (c) report in writing to the Minister as soon as possible after the end of each month, as at the close of business on the last day of that month, its purchases and sales of all grain during the month and the quantities of grain then held by it, the contracts to take delivery of grain to which it is then a party, all securities then held by it and the financial result of the Board's operations as at the end of that month, which report shall, notwithstanding any provision in the Auditor General Act , be certified by the Auditor General of Canada ;

(3) Paragraph 9(1)(e) of the Act is replaced by the following:

    (e) in each year, on or before March 31 or such other date as the Governor in Council may fix, report to the Minister in writing, as at the close of business on the last day of the preceding crop year, its purchases and sales of all grain during that crop year, the quantities of grain then owned by it, the contracts to take delivery of grain to which it is then a party, all securities then held by it and the financial result of the Board's operations as at the end of that crop year and such further information as the Minister may require, and the report shall, notwithstanding any provision of the Auditor General Act , be certified by the Auditor General of Canada .

COMING INTO FORCE

Coming into force

4. This Act shall come into force on a day to be fixed by order of the Governor in Council, but not later than one year after this Act is assented to.
