(5) In this section, ``Chairperson'' includes a person or class of persons designated, by name or by position, by the Chairperson.

36. Subsection 157(1) of the Act is amended by adding the following in alphabetical order:

``long-term supervision''
« surveil-

``long-term supervision'' has the same meaning as in Part I;

37. The Act is amended by adding the following after section 157:

Application to persons subject to long-term supervision order

157.1 A person who is required to be supervised by a long-term supervision order is deemed to be an offender for the purposes of this Part.

CRIMINAL RECORDS ACT

38. The Criminal Records Act is amended by adding the following after section 4:

Exception where long-term supervision

4.01 The period during which a person is being supervised pursuant to an order for long-term supervision, within the meaning of subsection 2(1) of the Corrections and Conditional Release Act is not included in the calculation of the period referred to in section 4 that must have elapsed after the expiration of sentence before an application for a pardon is considered.

PRISONS AND REFORMATORIES ACT

39. (1) The portion of the definition ``prisoner'' in subsection 2(1) of the Prisons and Reformatories Act after paragraph (b) is replaced by the following:

    who is confined in a prison pursuant to a sentence for an offence under an Act of Parliament or any regulations made thereunder, or pursuant to a committal for failure or refusal to enter into a recognizance under section 810 or 810.2 of the Criminal Code.

(2) If Bill C-17, introduced in the second session of the thirty-fifth Parliament and entitled An Act to amend the Criminal Code and certain other Acts, is assented to, then on the later of the day on which subsection 113(2) of that Act comes into force and the day on which subsection (1) comes into force, the portion of the definition ``prisoner'' in subsection 2(1) of the Prisons and Reformatories Act after paragraph (b) is replaced by the following:

    who is confined in a prison pursuant to a sentence for an offence under an Act of Parliament or any regulations made thereunder, or pursuant to a committal for failure or refusal to enter into a recognizance under section 810, 810.1 or 810.2 of the Criminal Code.

40. Paragraph 4(b) of the Department of the Solicitor General Act is replaced by the following:

    (b) parole, remissions, statutory release and long-term supervision within the meaning of subsection 2(1) of the Corrections and Conditional Release Act;

COMING INTO FORCE

Coming into force

41. This Act, any provision of this Act or any provision of an Act enacted by this Act comes into force on a day or days to be fixed by order of the Governor in Council.
