Amendments to the National Energy Board Act

188. Subsection 3(3) of the National Energy Board Act is replaced by the follow ing:

Re-
appointment and retirement

(3) A member appointed pursuant to sub section (2) is eligible to be re-appointed to hold office during good behaviour for any term of seven years or less.

189. The Act is amended by adding the following after section 5:

Compensation

5.1 The members of the Board are deemed to be employees for the purposes of the Government Employees Compensation Act and to be employed in the public service of Canada for the purposes of any regulations made pursuant to section 9 of the Aeronautics Act.

190. Section 6 of the English version of the Act and the heading before it are replaced by the following:

6. (1) The Governor in Council shall designate one of the members to be Chairper son of the Board and another of the members to be Vice-Chairperson of the Board.

Duties of Chairperson

(2) The Chairperson is the chief executive officer of the Board, and has supervision over and direction of the work and staff of the Board.

Duties of Vice-
Chairperson

(3) If the Chairperson is absent or unable to act or if the office of Chairperson is vacant, the Vice-Chairperson has all the powers and functions of the Chairperson .

Acting Chairperson

(4) The Board may authorize one or more of its members to act as Chairperson for the time being in the event that the Chairperson and Vice-Chairperson are absent or unable to act or if the offices are vacant.

191. Subsection 92(1) of the Act is re placed by the following:

Membership

92. (1) An Arbitration Committee shall consist of not less than three members ap pointed by the Minister each of whom shall receive such remuneration as is fixed by the Minister.

Terminology

192. The English version of the Act is amended by replacing the word ``Chair man'' with the word ``Chairperson'' in the following provisions:

    (a) subsection 4(1);

    (b) subsection 15(1);

    (c) subsection 92(3);

    (d) subsection 92(5); and

    (e) subsection 93(2).

Amendments to the National Film Act

193. (1) Subsection 4(2) of the National Film Act is replaced by the following:

Tenure of office

(2) Each member of the Board, other than the Commissioner , holds office during plea sure for three years.

(2) For greater certainty, each person who holds office as a member of the National Film Board immediately before the coming into force of subsection (1) continues in office during good behaviour for the remainder of the term for which the person was appointed, but may be removed by the Governor in Council for cause.

194. Section 6 of the Act is replaced by the following:

Fees and expenses

6. A member of the Board, other than the Commissioner or a member of the public service of Canada or Canadian Forces, may be paid such fee for each meeting of the Board that the member attends as may be fixed by by-law of the Board, and the members of the Board are entitled to be paid reasonable travel and living expenses incurred by them in the course of their duties under this Act while absent from, in the case of full-time members, their ordinary place of work and, in the case of part-time members, their ordinary place of residence .

195. Subsection 7(4) of the Act is re pealed.

196. The portion of subsection 10(1) of the Act before paragraph (a) is replaced by the following:

Powers of Board

10. (1) The Board may, for the purposes for which it is established,

197. Subsection 13(4) of the Act is re pealed.

198. (1) Subsections 16(1) and (2) of the Act are replaced by the following:

Appointment and remuneration

16. (1) There shall be a Government Film Commissioner who shall be appointed by the Governor in Council on the recommendation of the Minister after consultation with the Board and paid such remuneration as the Governor in Council may determine.

Appointment

(2) The Commissioner shall be appointed to hold office during pleasure for a period not exceeding five years.

(2) For greater certainty, the person who holds office as the Government Film Com missioner immediately before the coming into force of subsection (1) continues in office during good behaviour for the re mainder of the term for which the person was appointed, but may be removed by the Governor in Council for cause.

Prairie Farm Rehabilitation Committees

Amendments to the Prairie Farm Rehabilitation Act

199. Sections 3 to 5 of the Prairie Farm Rehabilitation Act are replaced by the following:

Duties of the Minister

4. The Minister shall study and establish methods and programs to facilitate the rehabi litation of the drought and soil drifting areas in the Provinces of Manitoba, Saskatchewan and Alberta, and to develop and promote within those areas systems of farm practice, tree culture, water supply, land utilization and land settlement that will afford greater economic security for those areas .

200. Paragraph 9(1)(a) of the Act is replaced by the following:

    (a) undertake the development, construc tion, promotion, operation and mainte nance of any project or scheme under or by virtue of this Act, or enter into agreements with any province, municipality or person with respect thereto; and

201. Every person who was a member of a Prairie Farm Rehabilitation Committee referred to in section 3 of the Prairie Farm Rehabilitation Act on the day on which section 199 of this Act comes into force ceases to hold office on the coming into force of section 199 of this Act.

Amendments to the Public Service Staff Relations Act

202. Paragraph 13(1)(a) of the Public Service Staff Relations Act is replaced by the following:

    (a) is not a Canadian citizen or permanent resident within the meaning of the Immigra tion Act ;

203. Paragraph 17(b) of the Act is re placed by the following:

    (b) is entitled to be paid reasonable travel and other expenses incurred by them in the course of their duties under this Act while absent from, in the case of a full-time member, their ordinary place of work and, in the case of a part-time member, their ordinary place of residence.

Amendments to the Royal Canadian Mounted Police Act

204. (1) The definitions ``Commission Chairman'' and ``Committee Chairman'' in subsection 2(1) of the English version of the Royal Canadian Mounted Police Act are repealed.

(2) Subsection 2(1) of the English version of the Act is amended by adding the following in alphabetical order:

``Commission Chairperson'' Version anglaise seulement

``Commission Chairperson'' means the Chair person of the Commission;

``Committee Chairperson'' Version anglaise seulement

``Committee Chairperson'' means the Chair person of the Committee;

205. (1) Subsections 25(1) and (2) of the Act are replaced by the following:

Committee established

25. (1) There is hereby established a committee, to be known as the Royal Cana dian Mounted Police External Review Com mittee, consisting of not more than three members, to be appointed by order of the Governor in Council.

Full- or part-time

(2) The members may hold office as full-time or part-time members.

(2) Section 25 of the Act is amended by adding the following after subsection (3):

(3.1) The Governor in Council shall desig nate one of the members to hold office as Committee Chairperson.

(3) Subsection 25(6) of the Act is replaced by the following:

Remuneration of full-time members

(6) Each full-time member of the Commit tee is entitled to be paid any remuneration and allowances in connection with the work of the Committee that may be approved by order of the Governor in Council.

(4) Subsections 25(8) and (9) of the Act are replaced by the following:

Travel and living expenses

(8) Each member of the Committee is entitled to be paid reasonable travel and living expenses incurred by the member in the course of the member's duties in connection with the work of the Committee while absent from, in the case of a full-time member, the member's ordinary place of work and, in the case of a part-time member, the member's ordinary place of residence.

Retirement pensions

(9) The full-time members of the Commit tee are deemed to be employed in the Public Service for the purposes of the Public Service Superannuation Act.

(10) The members of the Committee are deemed to be employees for the purposes of the Government Employees Compensation Act and to be employed in the public service of Canada for the purposes of any regulations made pursuant to section 9 of the Aeronautics Act.

(5) For greater certainty, the person who holds office as Chairman of the External Review Committee of the Royal Canadian Mounted Police immediately before the coming into force of subsection (2) contin ues in office during good behaviour for the remainder of the term for which the person was appointed, but may be removed by the Governor in Council for cause.

206. Subsections 26(2) and (3) of the Act are replaced by the following:

Absence or incapacity

(2) In the event of the absence or incapacity of the Committee Chairperson or if the office of Committee Chairperson is vacant, the Minister may authorize any member of the Committee to exercise the powers and per form the duties and functions of the Commit tee Chairperson .

Delegation

(3) The Committee Chairperson may dele gate to any member of the Committee any of the Committee Chairperson's powers, duties or functions under this Act, except the power to delegate under this subsection and the duty under section 30.

207. (1) Subsection 45.29(1) of the Act is replaced by the following:

Commission established

45.29 (1) There is hereby established a commission, to be known as the Royal Canadian Mounted Police Public Complaints Commission, consisting of a member for each contracting province and not more than five other members, to be appointed by order of the Governor in Council.

(2) Subsection 45.29(3) of the Act is replaced by the following:

Full- or part-time

(3) The members may hold office as full-time or part-time members of the Com mission.

(3) Section 45.29 of the Act is amended by adding the following after subsection (4):

(4.1) The Governor in Council shall desig nate one of the full-time members, other than a member for a contracting province, to hold office as Commission Chairperson.

(4) Subsections 45.29(7) to (9) of the Act are replaced by the following:

(9) Where the Commission Chairperson holds office on a full-time basis, the Commis sion Chairperson is entitled to be paid any remuneration in connection with the work of the Commission that may be approved by order of the Governor in Council.

(5) Subsections 45.29(11) and (12) of the Act are replaced by the following:

(11) Each member of the Commission is entitled to be paid reasonable travel and living expenses incurred by the member in the course of the member's duties in connection with the work of the Commission while absent from, in the case of a full-time member, the member's ordinary place of work and, in the case of a part-time member, the member's ordinary place of residence.

208. Subsections 45.3(2) and (3) of the Act are replaced by the following:

Absence or incapacity

(2) In the event of the absence or incapacity of the Commission Chairperson or if the office of Commission Chairperson is vacant, the Minister may authorize a member of the Commission, other than a member for a contracting province, to exercise the powers and perform the duties and functions of the Commission Chairperson .

Delegation

(3) The Commission Chairperson may delegate to a member of the Commission, other than a member for a contracting prov ince, any of the Commission Chairperson's powers, duties or functions under this Act, except the power to delegate under this subsection and the duty under section 45.34.

209. Section 45.44 of the Act is amended by adding the following after subsection (2):

Exception

(3) Notwithstanding subsection (2), in the case of the absence or incapacity of the member of the Commission appointed for the province in which the conduct that gave rise to the complaint occurred, the Commission Chairperson may designate, in that member's place, a member of the Commission appointed for another province.
