RECOMMENDATION

His Excellency the Governor General recommends to the House of Commons the appropriation of public revenue under the circumstances, in the manner and for the purposes set out in a measure entitled ``An Act to provide for mediation between insolvent farmers and their creditors, to amend the Agriculture and Agri-Food Administrative Monetary Penalties Act and to repeal the Farm Debt Review Act''.

SUMMARY

This enactment, which repeals and replaces the Farm Debt Review Act, provides, in respect of insolvent farmers, for

    (a) a review of the farmer's financial affairs;

    (b) mediation between the farmer and the farmer's creditors for the purpose of reaching a mutually acceptable arrangement; and

    (c) if the farmer so requests, an order temporarily suspending the right of creditors to take or continue proceedings against the farmer's assets.

The enactment makes it possible for the Agriculture and Agri-Food Administrative Monetary Penalties Act to apply in respect of contraventions.
