1. Section 207 of the Criminal Code is
amended by adding the following after
subsection (2):
|
|
Definitions
|
(2.1) In subsections (2.2) and (2.3),
|
|
``Internet'' « Internet »
|
``Internet'' means the international computer
network known by that name;
|
|
``Internet
service
provider'' « fournisseur de services Internet »
|
``Internet service provider'' means a person
who provides a service that facilitates
access to the Internet;
|
|
``regulations'' « règlements »
|
``regulations'' means the regulations
mentioned in subsection (2.4).
|

|
(2.2) Notwithstanding any of the provisions
of this Part related to gaming and betting, it is
lawful for the Government of Canada, either
alone or in conjunction with the government
of one or more provinces, to conduct and
manage a lottery scheme on the Internet in
accordance with the regulations.

Licensing

|
(2.3) The Government of Canada may
license an Internet service provider or other
person to operate and manage a lottery scheme
on the Internet
|
|

|
|
|
|
|
Regulations
|
(2.4) The Governor in Council may, on the
recommendation of the Minister, make
regulations for the purposes of subsections
(2.2) and (2.3).
|

|
2. The Act is amended by adding the
following after subsection 207(4):
|
|
Exception
|
(4.1) Paragraph 4(c) does not apply to a
game or proposal, scheme, plan, means,
device, contrivance or operation operated or
licensed pursuant to subsection (2.2) or (2.3).
|
