1. Subsections 25(3) and (4) of the
Criminal Code are replaced by the
following:
|
|
When not
protected
|
(3) Subject to subsections (4) and (5), a
person is not justified for the purposes of
subsection (1) in using force that is intended or
is likely to cause death or grievous bodily
harm unless the person believes on reasonable
grounds that it is necessary for the
self-preservation of the person or the
preservation of any one under that person's
protection from death or grievous bodily
harm.

(4) A peace officer, and every person
lawfully assisting the peace officer, is justified
in using force that is intended or is likely to
cause death or grievous bodily harm to a
person to be arrested, if
|

of escape

penitentiary
|
(5) A peace officer is justified in using force
that is intended or is likely to cause death or
grievous bodily harm against an inmate who
is escaping from a penitentiary within the
meaning of subsection 2(1) of the Corrections
and Conditional Release Act, if

2. The Coastal Fisheries Protection Act is
amended by adding the following after
section 8:
|
|

force
|
8.1 (1) A protection officer is justified in
using, in accordance with the procedures
established and to the extent permitted by the
regulations, force that is intended or is likely
to disable a foreign fishing vessel, if
|
|
|
|
|
|
|
|
|
|
|
Regulations
|
(2) The Governor in Council may make
regulations establishing the procedures in
accordance with which, and the extent to
which, a protection officer is permitted to use
the force referred to in subsection (1).

3. This Act or any provision thereof shall
come into force on a day or days to be fixed
by order of the Governor in Council.
