SUMMARY

The major elements of the enactment are the following:

Customs officers may examine, and immigration officers may examine and seize, documents relating to status or identity that could be used to circumvent the Immigration Act.

Access by serious criminals to immigration procedures that delay their removal from Canada is limited.

A refugee claim becomes inadmissible where the claimant is, or a senior immigration officer becomes aware that the claimant has been, convicted of a major crime in Canada.

The Immigration Appeal Division's jurisdiction to stay the removal of or allow appeals by serious criminals on humanitarian and compassionate grounds is limited.

Authority to determine requests, by persons who have been convicted of serious offences, for admission on the basis of rehabilitation is transferred from the Governor in Council to the Minister.

Non-permanent residents subject to security certificates issued by the Minister and the Solicitor General may not make an appeal to the Immigration Appeal Division.

Senior immigration officers may redetermine eligibility to claim refugee status in the case of fraud or multiple claims. They may also make exclusion or departure orders where one, but not all, allegations are within the senior immigration officer's jurisdiction.

The processing of citizenship applications of permanent residents who are subject to Immigration Act proceedings is suspended pending the outcome of the proceedings.
