CHAPTER 20

An Act to amend the National Library Act

[Assented to 15th June, 1994]

R.S., c. N-12; R.S., c. 1 (3rd Supp.); 1992, c. 1

      Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. The National Library Act is amended by adding the following after section 2:

HER MAJESTY

Binding on Her Majesty

2.1 This Act is binding on Her Majesty in right of Canada.

2. (1) Subsection 13(2) of the Act is repealed.

(2) Subsection 13(4) of the Act is replaced by the following:

Offence and punishment

(4) Every publisher of a book published in Canada who contravenes this section or the regulations is guilty of an offence and liable on summary conviction to a fine not exceeding the amount referred to in

    (a) subsection 787(1) of the Criminal Code, in the case of an individual; or

    (b) paragraph 719(b) of that Act, in the case of a corporation.

No imprisonment in default of fine payment

(5) Subsection 787(2) of the Criminal Code does not apply in respect of a fine imposed for an offence under this section.

Enforcement of fines

(6) Where a fine that is imposed on a person is not paid forthwith,

    (a) the prosecutor may, by filing the conviction, enter as a judgment the amount of the fine and costs, if any, in any civil court in Canada, other than the Federal Court, that has jurisdiction to enter a judgment for that amount; and

    (b) that judgment is enforceable against the person in the same manner as if it were a judgment rendered against that person in that court in a civil proceeding by Her Majesty in right of Canada.

Coming into force

3. This Act comes into force on a day to be fixed by order of the Governor in Council.
